A federal panel of the Sixth Circuit declares in a 2-1 decision that Michigan's ban on the consideration of race and gender in public university admissions (enacted pursuant to a successful voter-initiated amendment to the Michigan Constitution) violates the U.S. Constitution's Equal Protection Clause because it "unconstitutionally alters Michigan's political structure by impermissibly burdening racial minorities." The decision is inconsistent with a 1997 federal decision in the Ninth Circuit, thus creating a "split" among the federal circuits regarding whether such voter bans are constitutional under federal law. The State has indicated that it plans to appeal.
